   阿尔巴尼亚对腐败罪行实施的处罚包括处以罚金及最高为 20 年的监禁,视犯罪 行为的严重程度而定,此外还有附加或补充处罚。 豁免似乎不会在法律上妨碍有效起诉腐败相关罪行。《宪法》规定议员和法官享 有豁免权。在未得到议会或相关司法机构的授权之前,不得将其逮捕、不得剥 夺其自由或控制本人或其住所,除非在作案现场被抓捕或犯罪后立即被抓捕。 根据《宪法》第 90 条,阿尔巴尼亚共和国总统若严重违反《宪法》或犯下严重 罪行(未定义),可被解除职务。部长与议员享受同等豁免权。豁免仅限于搜查 和逮捕,不包括调查。 阿尔巴尼亚采用强制起诉体系(《刑事诉讼法》第 290 条)。 《刑事诉讼法》(第 227-267 条)对禁止出国、要求接受司法警察审问和禁止或 要求居住在某一地方等措施以及财产安全做了规定,以确保获释候审或上诉的 决定考虑到了被告出席后续刑事诉讼的情形。可通过法庭命令提前释放服刑人 员,但前提是刑期已服满一半至四分之三。 公职人员若被控犯罪,且该罪行按照法律应判处至少一年徒刑,法庭可暂停其 职务(《刑事诉讼法》第 241 条)。这适用所有在《公约》中述及、并在阿尔巴 尼亚被定为刑事犯罪的罪行。其他相关条款可参见《司法权力组织法》和《公 务员法》。《刑法》规定了开除公职或取消担任公职的资格的制裁(第 30 和 35 条)。《宪 法》的若干条款也同样适用。 阿尔巴尼亚未明确规定取消在国有企业任职的资格,但可按照《刑法》第 30 条 第 6 款剥夺在此类企业担任领导职位的权利。 《公务员法》第 58 条规定对公务员处以纪律制裁。可对腐败案例同时处以纪律 制裁和刑事制裁。 阿尔巴尼亚未制定特别方案来帮助被判定犯有腐败罪的人重新融入社会。

           Albania has adopted penalties for corruption offences that range from a fine up to 20 years’ imprisonment, taking into account the gravity of the offence, in addition to accessory or supplementary penalties. Immunities do not seem to constitute legal impediments to the effective prosecution of corruption-related offences. The Constitution provides for the immunity of parliamentarians and judges. They may not be arrested, deprived of liberty or subject to control over their person or dwelling without authorization from the Assembly or the relevant judicial body, unless caught in flagrante delicto or immediately after the commission of a crime. According to article 90 of the Constitution, the President of the Republic may be discharged for serious violations of the Constitution and for the commission of a serious crime (which is not defined). Ministers enjoy the same immunity as parliamentarians. Immunities are limited to search and arrest and do not cover investigations. Albania follows a system of mandatory prosecution (art. 290 CPC).The CPC (arts. 227-267) provides for measures, including prohibition to leave the country, obligation to appear before the judicial police, and prohibition or obligation to reside in a certain place, and for property security to ensure that decisions on release pending trial or appeal take into consideration the presence of the defendant at subsequent criminal proceedings. Early release by court order is possible if a period ranging from half to three-quarters of the prison sentence has been completed. A public official accused of an offence for which the law provides a prison sentence of not less than one year may be suspended from duty by the court (art. 241 CPC). This applies to all offences covered by the Convention and criminalized in Albania. Other relevant provisions can be found in the Law on the Organization of the Judicial Power and the Law on Civil Servants. The CC contains the sanction of removal or disqualification from holding public office (arts. 30 and 35). Several articles of the Constitution are also relevant. Albania does not explicitly provide for the disqualification from holding office in State-owned enterprises, although article 30, paragraph 6, of the CC could be used for the deprivation of the right to undertake leading positions in such enterprises. Article 58 of the Law on Civil Servants provides for disciplinary sanctions of civil servants. Both disciplinary and criminal sanctions can be imposed in corruption cases.Albania does not have customized programmes to promote the reintegration into society of persons convicted of corruption offences.
