《刑法典》第 308(4)(1)和(2)条将外国公职人员与国内官员一视同仁，其规定，《刑法典》第 311、 311.2、 312、 312.2 以及第 313 条中所指的官员也指外国的公职人员或者国际或超国家组织的公职人员。然而，《刑法典》第 308(4)(1)条对外国官员的定义却不如《反腐败公约》第二条第二款中的定义全面。
Foreign public officials are equated with domestic officials in Article 308(4)(1) and (2) CC, which provide that, for the purpose of Articles 311, 311.2, 312, 312.2 and 313 CC, an official is also a public official of a foreign State or of an international or supranational organization. However, the definition of foreign officials in Article 308(4)(1) CC is not as comprehensive as that in article 2(b) of the Convention against Corruption.
